App Terms & Conditions

1. Introduction
1.1 These App Terms are issued by nsaveLimited (‘nsave’, ‘us’, ‘we’) and apply to Members who haveaccepted these App Terms by downloading and using the nsave mobile device app.
1.2 TheseApp Terms are incorporated into and form part of the Membership Agreement. Youshould therefore read these App Terms together with our Membership Agreement(and any other documents mentioned in that agreement). Unless otherwise noted,any terms which are defined in the Membership Agreement have the same meaningin these App Terms. If there is any inconsistency between the MembershipAgreement and these App Terms, the Membership Agreement takes precedence.
1.3 These App Terms will applyuntil (a) you no longer have an open Account, or (b) you have removed the Appfrom all of your devices (whichever is the later). However, section 2 (About the App), section 7 (Acceptable use), and section 9(Limitations) will continue to apply.
2. About the App
2.1 Toaccess services provided by nsave (as set out in the Membership Agreement, andany terms and conditions relating to particular services) you will need todownload the App.
2.2 TheApp is intended for, and may only be used by, individuals aged 18 years ormore, who have full legal capacity, and who have at least one open Account.
2.3 Wegrant you a non-exclusive, royalty free licence to use the App and any updatesor supplements to it. This licence is personal to you, and you may notsub-licence, or transfer the App to another person (permanently or temporarily,in whole or in part). If you sell or transfer the device on which the App isinstalled, you must remove the App from the device.
2.4 Thecontents, features and functionalities of the App (including but not limited totext, graphics, user interface, visual interface, photographs, videos, databases,trademarks and logos) are the property of nsave (or its licensors) and may beviewed and used only for your personal, non-commercial use.
2.5 Youraccess to the App and the information contained therein does not in any wayconvey or transfer any right in or to the intellectual property rights of nsave(or any licensor) in respect of data or information displayed or accessiblefrom the App or in any of the trademarks, copyright, designs, patents, domainnames, know-how, confidential information, trade secrets or any otherintellectual property rights which may vest in nsave (or its licensor).
2.6 Nopart of the App may be reproduced, distributed, published, linked or deliveredto any other party for any purpose. In no event shall any person acquire titleto any software or App material by downloading it, or otherwise copying it,from the App.
2.7 Thoughwe take all reasonable care to ensure the correctness and accuracy of theinformation presented on the App, we do not warrant the adequacy, accuracy,reliability or completeness of the information contained therein and expresslydisclaim liability for errors or omissions. You are responsible for evaluatingthe reliability and completeness of any information or content available on theApp.
3. Additional terms
3.1 Aswell as the Membership Agreement, which applies to all Members, there are otherterms which may apply to services which may be accessed through the App. Additionalterms and conditions relating to services provided by us are appended to theMembership Agreement as ‘Modules’.
3.2 Touse the App, and any other services provided by nsave, you will need to open atleast one Account with one of our Partners. You will need to agree to the termsand conditions which apply to each Account that you open, and you may need toprovide additional information or meet additional requirements in order to openan Account or access any other Partner Services.
4. Devices and updating
4.1 Fromtime to time we will automatically update the App to improve performance,enhance functionality, reflect changes to mobile operating systems or addresssecurity issues. We may also ask you to update the App for those reasons. Ifyou choose not to install any update to the App, or if you opt out of automaticupdates, you may not be able to continue to use the App.
4.2 Ifyou download the App onto a device which is not owned by you, you must have theowner's permission to do so. You will remain responsible for complying withthese App Terms.
5. Charges
5.1 Thereis no separate charge for our provision of the App. However, in order to accessthe services provided through the App you will be required to pay theMembership Fee, as set out in the Membership Agreement, as well as any otherfees and charges which apply to additional services provided by us or our Partners(including but not limited to our Partners' provision of Accounts).
6. Variation
6.1 Wemay change these App Terms to reflect changes in law, regulation or bestpractice, or to deal with any additional features that we introduce to the App.We will give you 30 days' notice of any change by notifying you within the App,and (or) notifying you by email in accordance with the Membership Agreement. Ifyou do not accept the notified change, you will not be permitted to continue touse the App.
7. Acceptable use
7.1 Youmust not:
7.1.1 use the App in an unlawful manneror for an unlawful purpose, or in any manner inconsistent with these App Terms(or any other terms between us and you);
7.1.2 misusethe App or interfere with other users of the App by knowingly introducing orsending viruses, trojans, worms, logic bombs or other material which ismalicious or technologically harmful;
7.1.3 attackthe App via a denial-of-service attack or a distributed denial-of-serviceattack or any similar attack;
7.1.4 attemptto gain unauthorised access to the App or the server or data centre on whichthe App is stored or any server, cloud, computer or database connected to the App;
7.1.5 usethe App in a way that could damage, disable, overburden, impair or compromiseour systems or security or interfere with other users; and
7.1.6 collector harvest any information or data from our systems or attempt to decipher anytransmissions to or from the servers running any service relating to the App.
7.2 Ifany of your actions relating to the App (including but not limited to those setout at 0above) are contrary to applicable law, we will report any such action to therelevant law enforcement authorities and we will co-operate with thoseauthorities by disclosing your identity to them. In the event of a breach of 0above, your right to use the App will cease immediately.
7.3 Youundertake to ensure that all information, documentation, data and materialprovided or transmitted via the App or through any software, services, featuresor facilities on the App will be accurate, truthful and current, and that youwill be solely responsible for the content of such information, documentation,data and material.
8. Security
8.1 Ifyou have chosen or been provided with a username, password, or other securitydetails in order to access the App, you are responsible for the safeguardingand confidentiality of those security details.
8.2 Youmust tell us as soon as possible if you think someone else might know yoursecurity details or otherwise have access to the App on your device (includingif your device or your security details are lost or stolen). If you do notnotify us, we will be entitled to assume that any person accessing the Appusing your security details is you.
8.3 Wemay disable any security details, if we reasonably believe that you have failedto comply with any of the provisions of the Membership Agreement, these AppTerms, or if a Partner suspects, at its sole discretion, that you have breachedany of the account terms and conditions issued by that Partner.
9. Limitations
9.1 TheApp is provided for the purposes of accessing services provided by nsave andits Partners only. Although we make reasonable efforts to update theinformation provided by the App, we make no representations, warranties orguarantees, whether express or implied, that such information is accurate,complete or up to date.
9.2 TheApp has not been developed to meet your individual requirements. Please checkthat the facilities and functions of the App meet your requirements.
9.3 Werecommend that you back-up any content or data which you use in connection withthe App. We will not be liable for any loss of data arising from or impactingyour use of the App.
9.4 Youexpressly agree that the use of the App is at your sole risk. To the extentpermitted under applicable law, any and all warranty for the App is excluded.We provide the App ‘as is’ and ‘as available’ without warranty of any kind,either expressed or implied, including, but not limited to, the impliedwarranties of merchantability and fitness for a particular purpose and ofuninterrupted and (or) error-free availability and (or) accessibility ofservices.
9.5 Tothe maximum extent permissible by law, we will not be liable for any loss ordamage caused by a distributed denial-of-service attack, viruses or othertechnologically harmful material that may infect your telephone, computerequipment, computer programs, data or other proprietary material due to youruse of the App or due to your downloading of any material posted on it, or onany website or application linked to it.
9.6 Weendeavour to ensure, but cannot guarantee, unrestricted use and availability ofthe App. You acknowledge that access to the App (and the services which areprovided through the App) may be temporarily restricted for technical reasons(e.g., malfunctions, maintenance) or for reasons beyond our control (e.g.,force majeure, third-party fault, etc.).
9.7 Linksprovided in the App may be directed to third-party websites or applications,which are not owned nor controlled by nsave. Access to these third-partywebsites or applications is at your own risk and responsibility, and may besubject to the terms and conditions and privacy policies of the relevantthird-party providers.
10. Privacy and cookies
10.1 Asnoted in the Membership Agreement, we use your personal information as set outin our Privacy Policy (www.nsave.com/privacy), which you should read. Our CookiePolicy (www.nsave.com/terms/cookie) sets out information about the cookies usedby the App, and forms part of these App Terms.
