Card Funding Terms & Conditions

1. Introduction

‍

1.1 Scope of These Terms

These Card Funding Terms and Conditions (the “Card Funding Terms”) govern the funding of your USD Card through the nsave device application (the “App”). By accepting these Card Funding Terms, you authorise the transfer of funds from your nsave account to the wallet connected to your Card.

1.2 Regulatory Status and Corporate Authorization

The Card Wallet is operated by npay USA Inc., a company incorporated in Montana, USA and registered as a Money Services Business with the Financial Crimes Enforcement Network (FinCEN) under MSB RegistrationNumber 31000315267589. npay USA Inc is authorised to conduct business as a dealer in foreign exchange, money transmitter, and seller of prepaid access in Montana, Wyoming, and outside the United States.

1.3 Card Issuance and Regulatory Information

‍Cards are issued with Kulipa (https://www.kulipa.xyz/), a company registered with Company Number 981 570 088, acting as an agent of an Electronic Money Institution (EMI) in the European Economic Area, and are also issued with Monavate group entities. Monavate Limited is a company registered in England and Wales (Registration Number: 12472532) with registered offices at The Officers' Mess Business Centre, Royston Road, Duxford, Cambridge, England, CB22 4QH. Monavate Limited is authorised and regulated by the Financial Conduct Authority (Firm Reference Number: 901097). VAT Registration Number: 439 773 155. UAB Monavate is a company incorporated in Lithuania (Legal Entity Code: 305628001) with registered offices at Konstitucijos av. 21A, Vilnius, LT-08130, Lithuania. UAB Monavate is authorised and regulated by the Bank of Lithuania (Authorisation Code: LB002139).

1.4 Relationship to Other Agreements

These Card Funding Terms form part of your overall agreement with nsave and should be read together with the Membership Agreement, the App Terms & Conditions, the Card Terms and Conditions issued by the card provider, and any other applicable terms available at:

2. Definitions

‍

For the purposes of these Card Funding Terms:

  • “Card” means the USD Mastercard payment card issued to you through the nsave App.
  • “Card Wallet” means the digital wallet connected to your Card that holds funds available for card transactions.
  • “Funding Transaction” means the transfer of funds from your nsave Account to your Card Wallet.
  • “nsave Account” means any account you hold through the nsave App, including USD, GBP, or EUR accounts.

3. Authorisation to Transfer Funds

‍

3.1 User Authorisation

By accepting these Card Funding Terms and initiating a Funding Transaction, you authorise nsave and its affiliated service providers to transfer the specified amount from your nsave Account to your Card Wallet.

3.2 Movement of Funds Within the nsave Ecosystem

You acknowledge and agree that Funding Transactions involve the movement of funds between service providers within the nsave ecosystem. The Card Wallet is operated as part of the card services offered through nsave, in partnership with licensed and regulated financial service providers, including the card issuer and affiliated money services businesses.

3.3 Transaction Processing

Once a Funding Transaction is initiated and confirmed, the funds will be debited from your nsave Account and credited to your Card Wallet. Processing times may vary, although most transactions are completed promptly.

4. How Card Funding Works

‍

4.1 Funding Eligibility

To fund your Card, you must have a sufficient available balance in your nsave Account.

4.2 Conversion to Digital Asset

When you initiate a Funding Transaction, your funds are converted into a U.S. dollar-denominated digital asset held in your Card Wallet. This conversion occurs at a 1:1 rate (one U.S. dollar to one unit of the digital asset). The digital asset is designed to maintain a value equivalent to the U.S. dollar.

4.3 Use of Card Wallet Balance

Your Card Wallet balance is available for card payments and ATM withdrawals, subject to applicable limits. When you make a card transaction, the digital asset is converted back to the relevant currency at the applicable exchange rate.

5. Fees

‍

5.1 Funding Transaction Fees

Fees associated with Funding Transactions, if any, are disclosed in the App and in the nsave Schedule of Fees & Charges.

5.2 Card Transaction Fees

Additional fees may apply to card transactions as set out in the Card Terms and Conditions and on the nsave website:

5.3 Types of Fees

Fees may include transaction fees, conversion fees, withdrawal fees, network fees, and other applicable charges.

6. Limits

‍

6.1 Funding Limits

Funding Transactions may be subject to minimum and maximum limits displayed in the App.

6.2 Changes to Limits

Limits may vary based on account verification level, regulatory requirements, or risk considerations and may be changed at any time.

7. Your Responsibilities

‍

7.1 Sufficient Funds

You are responsible for ensuring that you have sufficient funds in your nsave Account before initiating a Funding Transaction.

7.2 Transaction Review

You are responsible for reviewing and confirming the details of each Funding Transaction before submission.

7.3 Lawful Use

You must not use the card funding feature for any illegal purpose or in violation of these Card Funding Terms, the nsave terms, or the Card Terms and Conditions.

8. Relationship Between Services

‍

8.1 Integrated Service Offering

Your nsave Account and Card are provided as part of an integrated nsave service offering. The card funding feature enables seamless movement of funds within this ecosystem.

8.2 Third-Party Service Providers

The card services, including the Card Wallet, are provided through a network of regulated entities and licensed service providers partnered with nsave, including licensed card issuers and registered money services businesses.

8.3 Card Terms Applicability

The Card and Card Wallet are subject to the Card Terms and Conditions. By funding your Card, you confirm that you have read and accepted those terms.

9. Data Sharing

‍

9.1 Consent to Data Sharing

By using the card funding feature, you consent to nsave sharing necessary information with affiliated service providers, including the card issuer and regulated partners, to process Funding Transactions, comply with applicable laws, and provide Card services, as further described in the nsave Privacy Policy.

10. Important Disclosures

‍

10.1 Nature of Card Wallet Funds

Funds transferred to your Card Wallet are held as digital assets within the card services infrastructure provided through nsave’s regulated partners.

10.2 Digital Asset Risks

While the digital assets held in your Card Wallet are designed to maintain a stable value equivalent to the U.S. dollar, they are subject to risks including technological failures, regulatory changes, and the possibility that the asset may not maintain its intended value at all times.

10.3 No Deposit Insurance

Funds in your Card Wallet are not protected by government deposit insurance schemes such as the FDIC (US) or FSCS (UK). Please refer to the Card Terms and Conditions for details on how funds are held.

10.4 Card Disputes

Card transactions and disputes related to card payments are governed by the Card Terms and Conditions.

11. Suspension and Termination

‍

11.1 Suspension of Card Funding

nsave may suspend or disable the card funding feature at any time due to suspected fraud, regulatory requirements, technical issues, or breach of these Terms.

11.2 Effect of Account or Card Termination

Termination of your nsave account or Card will automatically terminate your ability to initiate Funding Transactions.

12. Changes to These Terms

‍

12.1 Updates to Card Funding Terms

nsave may update these Card Funding Terms from time to time. Continued use of the card funding feature after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

‍

13.1 Applicable Law and Jurisdiction

These Card Funding Terms shall be governed by the laws of England and Wales. You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
